Article 1 – Definitions

These Terms of Service (hereinafter "ToS") govern access to and use of the Starkado.com website and associated services (hereinafter the "Service"), published by Starfruit SAS (hereinafter "Starfruit" or "we").
Accessing and using the Service constitutes full and unconditional acceptance of these ToS. Any user who refuses to accept them must refrain from using the Service.

"Service": all features accessible on the Starkado.com Site, enabling in particular the creation, management, and sharing of gift or wish lists.
"User": any adult natural person accessing the Service, with or without an account.
"Account": the User's personal space, accessible after registration, allowing them to manage their lists.
"User Content": any content (text, image, link, comment, etc.) published by the User on the Service.
"Merchant Third Party": any online sales website or platform (e.g. Amazon, Fnac, etc.) referenced or linked in a list, independent of Starfruit.

Article 2 – Access to the Service

2.1. Access conditions
The Service is accessible to any natural person with legal capacity. Minors may only create an account or use the Service with the prior consent of their legal representative.
The User is solely responsible for the compatibility of their equipment and internet connection with the Service.

2.2. Account creation
To access certain features, the User must create an account by providing accurate, complete, and up-to-date information. The User undertakes to keep this information current.
The User is solely responsible for the confidentiality of their login credentials. They must ensure their security and not disclose them to third parties. Any use of the account made using the User's credentials is presumed to have been made by them.
In the event of loss, theft, or unauthorised use of credentials, the User undertakes to notify Starfruit as soon as possible at .

2.3. Service availability
Starfruit uses its best efforts to keep the Service accessible and functioning properly.
The User acknowledges that access to the Service may be interrupted at any time, in particular for maintenance, development, updates, technical faults, network overload, or circumstances beyond Starfruit's reasonable control.
The Service may contain errors or malfunctions that will be corrected within reasonable timeframes, without any guarantee of result or specific deadline. Starfruit shall not be held liable for consequences arising from unavailability or slowdown of the Service.

Article 3 – Description of the Service

Starkado is a gift and wish list management application that enables users to:
create and manage personal lists of products or services;
share those lists with friends and family via a dedicated link;
reference products from third-party merchant sites via URL links;
indicate the User's wishes or needs for occasions (birthdays, weddings, births, etc.).

The Service does not constitute a sales platform. Starfruit is not a seller, reseller, or intermediary in transactions between the User (or their friends and family) and Merchant Third Parties. Any commercial transaction is concluded directly between the buyer and the Merchant Third Party, in accordance with the latter's terms and conditions.

Article 4 – Accuracy of Information

Lists created on the Service may include links to third-party sites as well as information about products (title, image, estimated price, availability, etc.) sourced from those sites or entered by the User.

This information is subject to change at any time and may contain errors or approximations. Starfruit does not guarantee its accuracy, completeness, or currency.

It is the responsibility of the User and any person viewing a list to verify directly on the merchant's site all relevant information before making any purchase (price, delivery charges, return conditions, availability, guarantees, etc.).

In the event of a discrepancy between the information displayed on the Service and that shown on the merchant's site, only the information on the merchant's site shall prevail.

Article 5 – User Obligations

5.1. Compliant use
The User undertakes to use the Service in accordance with these ToS, applicable laws and regulations, and the rights of third parties.

In particular, the User undertakes not to:
publish unlawful, defamatory, abusive, obscene, discriminatory, violent, or human-dignity-violating content;
publish content that infringes the intellectual property rights of third parties (trademarks, copyright, patents, etc.);
impersonate a third party or mislead others as to their identity;
use the Service for commercial, advertising, or prospecting purposes without prior consent from Starfruit;
use the Service to transmit viruses, malware, or any code capable of damaging Starfruit's or third parties' systems;
attempt to circumvent the Service's security measures or disrupt its operation;
carry out automated data collection or scraping of user data without prior written authorisation.

5.2. User Content
The User is solely responsible for the User Content they publish on the Service. They guarantee to Starfruit:
that they hold all necessary rights to such content;
that such content does not infringe the rights of third parties;
that such content complies with these ToS and applicable law.
By publishing User Content, the User grants Starfruit a worldwide, non-exclusive, royalty-free, and transferable licence to use, reproduce, host, display, and distribute that content in the context of providing and promoting the Service.

5.3. User liability
The User agrees to indemnify Starfruit, its officers, and employees against any claim, complaint, demand, or judgment resulting from a breach of these ToS or unlawful use of the Service on their part.

Article 6 – Moderation and Suspension

Starfruit reserves the right, without notice or compensation, to:
delete or make inaccessible any User Content that is manifestly unlawful or contrary to these ToS, once it has become aware of it;
temporarily suspend or permanently close the account of any User in the event of a serious or repeated breach of these ToS.

The decision to moderate or suspend shall not give rise to any liability on the part of Starfruit towards the User concerned.

Article 7 – Affiliate Links

Certain links appearing in lists or displayed on the Service may be affiliate links. Starfruit may receive a commission on sales generated through these links, without any additional cost to the buyer.

This information is provided in accordance with applicable legal transparency obligations.

Article 8 – Intellectual Property

The Service, its architecture, visual identity, content, and all elements comprising it are the property of Starfruit or are subject to regularly granted licences. They are protected by intellectual property law.

Any unauthorised reproduction, representation, modification, or use is prohibited and constitutes an infringement.

Starfruit's trademarks, logos, and domain names (including Starkado) may not be used without its prior written authorisation.

Article 9 – Limitation of Liability

To the fullest extent permitted by applicable law, Starfruit, its officers, partners, employees, and agents shall not be held liable for:
any indirect or consequential damage (data loss, loss of chance, loss of revenue, reputational harm, etc.);
damages resulting from non-compliant use of the Service, these ToS, or the law;
damages attributable to a third party (including Merchant Third Parties, hosting providers, or internet service providers) or to force majeure;
any dispute or loss related to transactions between the User (or their friends and family) and Merchant Third Parties (product defects, delays, cancellations, non-conformity, etc.);
consequences of unavailability, slowdown, or malfunction of the Service.

Starfruit's aggregate and cumulative liability, regardless of the cause, is strictly limited to the greater of: (i) amounts actually paid by the User to Starfruit for the Service during the twelve (12) months preceding the occurrence of the event giving rise to the claim, or (ii) the sum of 50 euros.

These limitations do not apply where the law prohibits the exclusion or limitation of liability, including in cases of personal injury, gross negligence, or wilful misconduct.

Article 10 – Account Suspension and Termination

The User may close their account at any time by sending a request to or via their account settings.

Closing the account results in the permanent deletion of associated data, subject to legal retention obligations and the provisions of the Privacy Policy.

Starfruit reserves the right to terminate the User's account in the event of a serious or repeated breach of these ToS, following prior notification by email except in emergencies (in particular in cases of unlawful content or serious infringement of third-party rights).

Article 11 – Changes to the Service and ToS

Starfruit reserves the right to modify, at any time and without notice, the operation, features, or interface of the Service.

These ToS may be amended by Starfruit at any time. Changes will be notified to the User by any appropriate means (email, notification on the Site) at least 30 days before they take effect, except where changes are required by a legal or regulatory obligation.

Continued use of the Service after the new ToS take effect constitutes acceptance of those ToS. Otherwise, the User may close their account in accordance with the procedures set out in Article 10.

Article 12 – Personal Data

The processing of the User's personal data is governed by the Privacy Policy available on the Site, which forms an integral part of these ToS.

Article 13 – Applicable Law and Dispute Resolution

These ToS are governed by French law.

In the event of a dispute, the User is invited to contact Starfruit at in order to seek an amicable resolution.

Failing an amicable resolution, any dispute relating to the formation, interpretation, or performance of these ToS shall be submitted to the competent courts, subject to mandatory rules protecting consumers.
